1. APPLICABLE LEGISLATION
The second section of Article 22 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:
1.Service providers may use data storage and retrieval devices on the end-user’s terminal equipment, provided that the user has given their consent after being provided with clear and complete information about their use, in particular regarding the purposes of data processing, in accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data.
When technically possible and effective, the user’s consent to accept the data processing may be provided through the appropriate browser settings or other applications, provided that the user must configure these settings during installation or updates through an explicit action for this purpose.
This will not prevent the possible storage or technical access solely for the purpose of transmitting a communication over an electronic communications network or, as strictly necessary, to provide a service of the information society expressly requested by the user.
As stated in the “Guide on the Use of Cookies,” published by the Spanish Data Protection Agency (AEPD) in 2013, the LSSI-CE applies to any type of file or device downloaded to a user’s terminal equipment for the purpose of storing data that can be updated and retrieved by the entity responsible for its installation. The cookie is one of these widely used devices, so we will refer to these devices generically as cookies.
Exempt from compliance with the obligations established in Article 22.2 of the LSSI-CE are cookies used for the following purposes:
Allowing only communication between the user’s device and the network.
Strictly providing a service explicitly requested by the user.
2. TYPES OF COOKIES BASED ON THEIR PURPOSE
A cookie is a file that is downloaded to your computer when accessing certain websites. Cookies allow a website, among other things, to store and retrieve information about the browsing habits of a user or their device and, depending on the information contained and how the device is used, they can be used to recognize the user.
As outlined in the “Guide on the Use of Cookies” from the AEPD, depending on the purpose for which the data obtained through cookies is processed, we can distinguish between:
Technical cookies: These allow the user to navigate a website, platform, or application and use the different options or services available, such as controlling data traffic, identifying the session, accessing restricted parts, remembering items in a shopping cart, processing a purchase, signing up for or participating in an event, using security features during browsing, storing content for video or audio streaming, or sharing content on social networks.
Personalization cookies: These allow the user to access a service with some predefined general features based on certain criteria on the user’s terminal, such as language, browser type, regional settings, etc.
Analytics cookies: These allow the entity responsible for them to track and analyze the behavior of users on the websites they are linked to. The information collected by these cookies is used to measure activity on websites, apps, or platforms and to create user navigation profiles to make improvements based on usage data analysis.
Advertising cookies: These allow the most efficient management of advertising spaces that the publisher has included on a website, app, or platform from which the requested service is provided, based on criteria such as the edited content or the frequency with which ads are shown.
Behavioral advertising cookies: These allow the most efficient management of advertising spaces that the publisher has included on a website, app, or platform from which the requested service is provided. These cookies store information on user behavior obtained through continuous observation of their browsing habits, allowing the creation of a specific profile to display targeted advertising based on that profile.
3. PRINCIPLE OF INFORMATION
In compliance with the provisions of Article 5 of Organic Law 15/1999, of December 13, on the Protection of Personal Data (LOPD), we inform you expressly, accurately, and unequivocally that the information obtained through the cookies installed on your computer will be used for statistical purposes.
The recipients of the information obtained through the cookies installed on your computer will be AICRUMIT S.L.
4. PRINCIPLE OF CONSENT
Consent for the installation of cookies will be considered granted through the marking of the checkbox for acceptance of the “Cookie Policy” provided on our website.
In cases where the user does not explicitly indicate whether they accept the installation of cookies but continues to use the website or application, it will be understood that they have given their consent, with our entity expressly informing them of the possibility to block or delete the cookies installed on their device by configuring the browser settings.
5. OPTIONAL NATURE OF COOKIE INSTALLATION
Although accepting the installation of cookies on your computer is optional, refusal to install them may limit or prevent the functionality of the website, making it impossible to provide services through it.
6. DISABLING COOKIES
The user may change the cookie settings, block or deactivate them at any time. We provide instructions for doing so in the main browsers:
